1. Legal Framework
These Terms and Conditions regulate the mutual relationship between the Seller and the buyer (hereinafter: the Buyer) arising from the purchase of products from the Seller's website. The Seller ensures all conditions for lawful business operation and sale. By accepting these Terms and Conditions, the Buyer is obliged to comply with them. The Seller reserves the right to amend and supplement the Terms and Conditions at any time. These Terms are compiled in accordance with the regulations of the Republic of Serbia, specifically: the Law on Obligations, the Law on Consumer Protection, the Law on Electronic Commerce, the Law on Personal Data Protection, and accompanying sub-legal acts.
2. Definitions
Seller: Danijela Mladenović PR Radnja za proizvodnju ulja i masti Aronica Jagodina, PIB: 110973165.
Buyer: An adult, legally capable person, who purchases products for personal use.
Consumer: A natural person who purchases products for personal use.
Terms and Conditions: These general business terms of the Seller.
Site: The Seller's website zdravaulja.rs.
3. Terms of Purchase
An order sent through the Site represents the Buyer's offer to conclude a contract. The contract is concluded when the Seller electronically confirms the receipt and acceptance of the order. All prices are in RSD and include VAT, unless otherwise indicated. Product images and descriptions are informative; deviations in colour shade due to screen display are not a basis for non-conformity per se.
4. Purchase Procedure
The Buyer orders products via the Site by adding products to the cart. The purchase is performed by creating an order and entering all necessary data (address, payment method, courier service selection). The Buyer is obliged to enter accurate and complete data. The Seller is not responsible for inaccurate data. The order is finalized and confirmed when the Buyer receives electronic confirmation of the order receipt.
5. Payment Methods and Delivery
Payment Methods: Payment is made in one of the following ways:
-
Cash on delivery (cash payment upon receiving the shipment).
-
Payment by cards or electronic payment (if enabled in the cart).
-
Payment by bank transfer (based on a proforma invoice).
Delivery:
Delivery is carried out via a courier service to the Buyer's address, within 2 to 4 working days from the day of dispatch. The dispatch deadline is calculated from the moment of checking product availability and order confirmation. The Buyer bears the delivery costs. The Seller is obliged to adequately package the product.
6. Right of Withdrawal (Withdrawal from the Contract)
The Buyer has the right to withdraw from the contract concluded at a distance without stating any reasons within 14 days from the day of receipt of the goods.
Withdrawal is exercised by sending an unequivocal statement to: aronica381@gmail.com. Upon receipt of the statement, the Seller electronically confirms the receipt without delay.
The withdrawal statement produces legal effect on the day of its receipt by the Seller. The Seller is obliged to confirm the receipt of the statement to the Consumer.
7. Consequences of Withdrawal – Return of Goods and Refund
Upon withdrawal from the contract, the Consumer must return the goods to the Seller without delay, and no later than 14 days from the day the withdrawal statement was sent. The goods are considered returned within the deadline if the Consumer dispatched the goods before the deadline expired.
The goods must be unused, undamaged, and in the original packaging. The Consumer is exclusively responsible for the diminished value of the goods resulting from handling the goods in a manner that is not adequate, i.e., exceeds what is necessary to establish the nature, characteristics, and functionality of the goods.
The costs of returning the goods are borne by the Consumer. In case of withdrawal, the Seller is obliged to refund payments received from the Consumer within 14 days from the day of receiving the withdrawal statement.
The Seller reserves the right to delay the refund until the goods are received back or until the Consumer provides proof that the goods have been dispatched.
8. Conformity
The Seller is responsible for the non-conformity of the goods with the contract that appears within two years from the day the risk passes to the Buyer. It is presumed that the non-conformity existed at the time the risk passed if it appears within six months from the day of purchase.
9. Warranty
Without prejudice to the Seller's liability for conformity, the Seller or the manufacturer (hereinafter: the Guarantor) may issue a warranty. A warranty is any statement that assumes an obligation regarding the goods, which is legally binding. The warranty must be made in writing and contain: details about the goods, statement of coverage, term of duration, territorial validity, details about the Guarantor, and that the warranty does not affect the Consumer's statutory rights.
10. Complaints (Procedure)
The Buyer files a complaint with the Seller in writing, via electronic mail: aronica381@gmail.com, or in writing to the headquarters address. The complaint must contain: Buyer's details, description of the non-conformity, request from the complaint, and the date of submission.
The Seller is obliged to respond to the Buyer within eight days from the day of receipt of the complaint. The Seller is obliged to resolve the complaint no later than 15 days from the day of submission. The Seller accepts, rejects the complaint, or issues a statement regarding the proposed solution.
Note: For products where the Seller is not the Seller but an intermediary in the sale, i.e., the products are not owned by the Seller, the Seller provides support to the Buyer in resolving the complaint with the actual Seller of the product. In these cases, the Seller is not obligated to fully apply the deadlines mentioned above but undertakes to mediate the resolution of the complaint with the actual Seller in the shortest possible time.
11. Durable Medium and Contractual Obligation
The Seller undertakes to provide the Buyer, after the conclusion of the contract, on a durable medium (electronic mail), with confirmation of the contract and key information necessary for exercising rights arising from the purchase (email confirmation of the order), including a link to these Terms and Conditions.
The Seller ensures the permanent acceptance of the terms of all orders in accordance with the Law. The Seller undertakes to honour all orders, and the Buyer undertakes to take over and pay for the order, thereby accepting the permanent nature of the concluded contract.

13. Limitation of Liability

14. Personal Data Protection (Basis)

Data processing is carried out for the purpose of contract execution (sale), legal obligations (accounting, fiscalization), legitimate interests (service improvement, fraud prevention), and consent (newsletter, marketing).
More details on the processing of personal data, rights, and obligations can be found in the Seller's Privacy Policy.
15. Cookies
The Seller's Site uses cookies. Cookies are used for: basic site functionality, statistics (e.g., Google Analytics, with consent), marketing (e.g., Facebook Pixel, with consent), and site optimization. The use of cookies is carried out with the Buyer's consent. The Buyer may refuse the use of cookies (except necessary ones) or withdraw consent at any time.
16. Out-of-Court Resolution of Consumer Disputes
As a merchant, we are legally obliged to participate in the procedure for the out-of-court resolution of consumer disputes. The Consumer may initiate the procedure only after having previously filed a complaint with the Seller and after receiving a response/outcome. The procedure lasts a maximum of 90 days. The Ministry of Trade maintains and publishes the list of bodies for out-of-court resolution (see the official list of the Ministry). The work of the bodies is free of charge; each party bears its own costs (representation, travel expenses, etc.).
